GENERAL TERMS OF USE OF THE ONLINE STORE AT WWW.WESTWING.HR
Below are our General Terms and Conditions (hereinafter referred to as “ General Terms and Conditions ”) that apply to the use of the Westwing (online) shop on the website www.westwing.hr. By submitting an order, you accept the following General Terms and Conditions of Westwing GmbH, Moosacher Str. 88, 80809 Munich, Germany (hereinafter referred to as “ Westwing ”). Contact details are available in Article 16. SERVICE AND COMPLAINTS.
These General Terms and Conditions apply to consumers with a billing address in Croatia who use our website. For the purposes of these General Terms and Conditions, a consumer is any natural person who acts on the market outside the scope of their trade, business, craft or professional activity.
1. GENERAL PROVISIONS AND SCOPE
1.1 Westwing operates an online store on the website www.westwing.hr.
1.2 To use the offers available on the website, persons must be over 18 years of age.
1.3 As a rule, goods and services are sold only in quantities that are customary for households.
1.4 These General Terms and Conditions apply to all contracts concluded via the website www.westwing.hr, unless the B2B General Terms and Conditions for Business Users apply.
1.5 If (working) days are stated as deadlines, this refers to all working days except Saturday, Sunday and public holidays, in both the country (the country in which the Westwing merchant is located) and Croatia.
2. USE OF THE WWW.WESTWING.HR WEBSITE AND REGISTRATION
2.1 When placing an order, you will be asked to provide personal information that will be collected and processed in accordance with the Westwing Privacy Policy. Please see article 19 of these General Terms and Conditions.
2.2 You are responsible for the completeness and accuracy of the data. You are also obliged to keep your data up to date. If there is a change in the data you have provided during your use of the website, you must correct the information immediately. You are obliged to keep your passwords and other access data confidential and protect them from access by unauthorized third parties.
2.3 You are solely responsible for the content (such as product reviews) that you publish in the sections made available for this purpose. You guarantee that your own content does not infringe or violate the rights of third parties (e.g. personality rights or copyrights). In this regard, you will fully indemnify Westwing against all claims by third parties upon first request. By submitting content to Westwing, you grant Westwing and all affiliated companies of the Westwing Group (hereinafter referred to as the “ Westwing Group ”) all non-exclusive and unrestricted rights of use in terms of time, space and content, as well as for transmission to third parties, which Westwing requires for the publication and distribution of the content, even in part, on the Westwing Group’s websites.
2.4 In your user account you can view and, if necessary and where possible, modify your open, recently sent and/or completed orders, as well as manage and store your data, vouchers, flyers and notifications separately.
2.5 You can register with only one user account in the store on the website www.westwing.hr and you can use only one user account at a time. If Westwing detects multiple registrations, Westwing may delete them.
2.6 It is prohibited to use the website www.westwing.hr or its content for illegal or abusive purposes or for purposes prohibited by these General Terms and Conditions. In particular, it is not permitted to interfere with or manipulate technical processes. In the event of unjustified behavior or attempts to gain unjustified advantages to the detriment of Westwing or other customers, Westwing reserves the right to block the user account and not accept orders.
2.7 Westwing reserves the right to enforce its virtual house rules at its own discretion and, for example, to issue warnings, refuse orders, limit available payment methods, suspend or terminate access to the website www.westwing.hr or the user account or remove uploaded content if the provisions of these General Terms and Conditions are violated or if there is an abuse of rights. Your right to unilaterally terminate the contract in accordance with Article 12 shall not be limited in any way by the measures set out above. This shall not affect Westwing's claims for damages.
3. CONTRACTING PARTIES, LANGUAGE AND CONCLUSION OF THE CONTRACT
3.1 The contracting party when concluding a contract on the website www.westwing.hr is Westwing.
3.2 The website www.westwing.hr operates in the Croatian language. Contracts via the website are concluded exclusively in the Croatian language.
3.3 Once the selected products and services have been placed in the virtual shopping cart and the electronic ordering process has been completed, you submit a legally binding contractual offer by submitting an order for the goods and services in the virtual shopping cart by clicking on the “Pay now” button when using a credit card or other direct payment method in the shopping cart or by clicking on “Complete order with payment obligation” in the case of deferred payment. After submitting your offer, you will receive an email from Westwing confirming receipt of your offer. This email from Westwing does not constitute acceptance of the offer and the conclusion of a contract. Westwing decides whether to accept the offer. If Westwing does not accept the offer, Westwing will inform you immediately. The contract is concluded via a separate email with confirmation of dispatch of the goods.
3.4 Westwing stores the order data and sends it to you by email after placing the order. This email also contains the cancellation policy. You can download the general terms and conditions at any time at https://www.westwing.hr/i/terms_and_conditions/ . If you have created a user account before placing the order, you can always view your order data in the login section. This also applies to previous orders within the scope of legal retention obligations.
3.5 Order processing and contact are usually carried out via an automated order processing process or via email. You must ensure that the email address you provide for order processing is correct, so that emails sent by Westwing can be received at that address. Especially if you use spam filters, you must ensure that all emails sent by Westwing or third parties engaged by Westwing to process your order can be delivered.
4. PRICES AND DELIVERY COSTS
4.1 For orders of goods on the website www.westwing.hr , the prices specified on the page with details of the corresponding product at the time of ordering apply. Prices are total prices including VAT and packaging. Shipping costs are added.
4.2 The prices of the products in your virtual cart will always correspond to the current price on the product details page. This means that the current price of the product may differ from the price at which you added the product to your virtual cart. When you add a product to your virtual cart, you do not reserve the price displayed at that time. The price of the product may increase or decrease between the time you add the product to your virtual cart and the time you actually purchase it.
4.3 Shipping costs are charged separately for each order and are based on the price stated on the product detail page. This depends, among other things, on the size, weight and appropriate shipping method. The latter is determined at Westwing's sole discretion.
5. TERMS AND METHODS OF PAYMENT
5.1 You can pay for goods and services using one of the following payment methods: Paypal, credit card (VISA, Mastercard, American Express), Apple Pay, Google Pay (available only when ordering via a web browser).
5.2 Westwing accepts several credit cards, currently: VISA and Mastercard as well as American Express. Westwing will charge your credit card upon receipt of your order via our payment service provider Stripe Payments Europe Ltd, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland (a company registered in the Irish Register of Companies under number 3206488LH).
5.3 In the event that ApplePay or GooglePay (for orders via a web browser only) is selected as the payment method, the payment will be processed through our payment service provider Stripe Payments Europe Ltd (a company registered in the Irish Register of Companies under number 3206488LH).
5.4 If a payment method offered by PayPal is selected, the payment will be processed through the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (company registered in the commercial register under number RCS Luxembourg B 118 349), in accordance with the PayPal User Agreement, available at https://www.paypal.com/en/legalhub/paypal/useragreement-full.
6. ISSUING INVOICES
6.1 By accepting the General Terms and Conditions, you agree that Westwing may send you an invoice electronically or make it available to you electronically, in accordance with Article 232 of Council Directive 2006/112/EC and the relevant provisions of the Croatian Value Added Tax Act. (Official Gazette 73/2013, 99/2013, 148/2013, 153/2013, 143/2014, 115/2016, 106/2018, 121/2019, 138/2020, 39/2022, 113/2022, 33/2023, 114/2023, 35/2024, as amended).
6.2 Please note that if your details are not accurate as per clause 2.2 when placing your order, we are unable to issue a correction invoice to correct your details after your order has been completed.
7. VOUCHERS
7.1 Westwing offers different types of vouchers: Gift vouchers and Compensation vouchers:
7.1.1 Gift certificates
7.1.1.1 Gift vouchers are vouchers that can be purchased in-store and used only on www.westwing.hr , unless otherwise stated on the voucher. The gift voucher will be sent to you via email after your order has been placed.
7.1.1.2 Gift vouchers and remaining gift voucher amounts can be used until the end of the third year following the year of purchase of the gift voucher.
7.1.1.3 Gift certificates can only be used to purchase goods and services, and not to purchase other gift certificates.
7.1.1.4 If the price of your order is higher than the amount of the gift voucher, you can compensate the difference using the offered payment methods. If the price of your order is less than the amount of the gift certificate, you can use the remaining amount on your next order.
7.1.1.5 In case of cancellation of the contract, for any reason, the purchase price will be returned to the account of the voucher, as well as to any additional payment method, if it was used during the purchase.
7.1.1.6 The gift voucher is transferable.
7.1.1.7 Lost vouchers, especially stolen vouchers, will not be replaced. Westwing does not accept responsibility for the loss of voucher codes.
7.1.2 Compensation vouchers
7.1.2.1 Compensation vouchers are vouchers that cannot be purchased, but are issued by Westwing at its discretion as compensation without acknowledging any legal obligation.
7.1.2.2 The rules on gift certificates apply accordingly.
7.2 Westwing may, in the event of reasonable suspicion of fraud or other activities contrary to the law or the terms and conditions applicable to the purchase or redemption of vouchers, block the relevant voucher code (also temporarily) or refuse to redeem the voucher (also temporarily). In the latter case, you have the right to cancel the order.
7.3 Payment of the voucher amount is not possible, nor is the transfer of value or subsequent offset for purchases already made, i.e. before the completion of the ordering process.
7.4 The above vouchers can only be obtained by consumers.
8. DELIVERY AND SHIPPING TERMS
8.1 Deliveries will only be made within Croatia to the delivery address you have provided.
8.2 Basic delivery times are communicated to you on the relevant product details page.
8.3 The ordered goods will be sent as a package or by courier at Westwing's discretion.
8.4 Westwing does not assume any additional procurement risk, in particular in the case of the purchase of generic products. Westwing is obliged to deliver the goods to the customer from its own stock of goods or to deliver goods that have been specially ordered from the supplier. Westwing's obligation to deliver the goods to the customer does not apply if the goods are not delivered, not delivered in full or not delivered on time to Westwing despite an existing cover transaction with the relevant supplier and Westwing is not responsible for this delay or problem with the supplier. In such a case, Westwing will inform you immediately. If the supplier does not deliver to Westwing, you acknowledge that Westwing does not assume any obligation to procure the goods. Westwing will refund any advances paid by the customer.
8.5 Westwing cannot be held liable for non-performance or improper performance of Westwing's obligations under this agreement if and to the extent that this is a consequence of force majeure, notwithstanding that Westwing will do everything in its power to minimize the consequences of such an event.
Force majeure means any unforeseeable event or events which, even if foreseeable, are beyond the control of Westwing and whose effect on the performance of the contract could not have been avoided by reasonable efforts on the part of Westwing. This includes, but is not limited to, war, wartime conditions, strike, rebellion, military or civil coup, insurrection, riot, embargo, government orders, fire, flood, storm surge, hurricane or other severe weather events of catastrophic magnitude, earthquake, lightning strike, pandemic, epidemic, nuclear hazard or similar cause which is beyond the control of Westwing and which makes the fulfillment or performance of the obligations governed by these General Terms and Conditions unlawful, impossible or commercially unfeasible. If a force majeure event occurs, Westwing shall be obliged to inform you immediately. Westwing shall be released from its performance obligation for the duration of the event. The delivery and performance deadlines shall be extended accordingly. If the force majeure lasts for more than 2 weeks from the scheduled delivery date, Westwing and you shall be entitled to terminate the contract.
8.6 If delivery of the goods fails for reasons for which you are responsible, Westwing will charge you the costs of the new delivery as well as reasonable storage costs from the date of the failed delivery. You will be charged for the new delivery even if the first delivery was free of charge for you. We will inform you of the additional costs before the new delivery and will only make the delivery with your consent. Please note that refusal of acceptance does not constitute effective exercise of your right to unilaterally terminate the contract, which must be made in the form of an unequivocal statement given to Westwing, as prescribed in Article 11. Westwing reserves the right to unilaterally terminate the contract if you do not accept the new delivery within 7 days. In such a case, Westwing will refund any payments already made to you. This also applies if you exercise your right to unilaterally terminate the contract. In such a case, you will also be refunded the delivery costs (standard delivery).
9. LIABILITY FOR DEFICIENCIES AND DAMAGE DURING TRANSPORT
9.1 Unless otherwise stated in the following provisions, the provisions of statutory liability for defects prescribed by the Croatian Civil Obligations Act, Articles 399.a – 422.a, shall apply.
9.2 In the case of a contract for the delivery of used goods, the following limitation applies: the limitation period for claims for defects is one year from the delivery of the goods.
9.3 to the extent permitted by applicable regulations, Westwing's liability is limited to cases of intent and gross negligence on the part of Westwing.
9.4 The above limitations and exclusions of liability under Article 9.3 do not apply if the material defect was known or could not have remained unknown to Westwing or Westwing has provided a commercial warranty for the goods, as described in Article 10.
9.5 If the goods are delivered with obvious damage to the packaging or contents, please immediately file a complaint with the relevant delivery person and contact Westwing Customer Service (service@westwing.hr). The notification has no effect on your claims under the statutory rules on liability for material defects.
10. COMMERCIAL WARRANTY
An additional commercial warranty is only available if expressly stated and described on the product detail page.
11. CONSUMER'S RIGHT TO UNILATERALLY TERMINATE THE CONTRACT
You may unilaterally terminate the contract within fourteen (14) days without giving any reason. The period for unilateral termination is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the goods that are the subject of the contract.
In order to exercise your right to unilateral termination, you must inform us of your decision to unilaterally terminate the contract by an unequivocal statement (e.g. by e-mail or letter sent by post). You may use the following model form for unilateral termination of the contract, which is not mandatory:

In order to comply with the deadline, it is enough to send a notice of unilateral termination of the contract before the expiration of the deadline for exercising the right to unilateral termination of the contract.

12. CONSEQUENCES OF UNILATERAL TERMINATION OF THE CONTRACT
If you have unilaterally terminated the purchase contract, we will reimburse to you all payments we have received from you, including delivery costs, without undue delay and at the latest within fourteen (14) days from the day on which we receive notification of the unilateral termination of the contract. For the reimbursement, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you. In no case will you be charged for this reimbursement. We may refuse the reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods immediately, and in any case within fourteen (14) days from the day on which you inform us of your unilateral termination of the contract to the following address. The return address depends on the carrier who delivered the goods:

The deadline is met if you send the goods back before the fourteen-day deadline has expired. We will bear the costs of returning the goods, provided that the goods are returned in accordance with our returns instructions described here. You will only be liable for any diminished value of the goods resulting from handling of the goods that goes beyond what was necessary to establish the nature, characteristics or functioning of the goods.
The right to unilaterally terminate the contract does not exist for the exceptions listed in Article 86 of the Croatian Consumer Protection Act, in particular when (i) the subject of the contract is goods that are made to the consumer's specifications or that are clearly adapted to the consumer (ii) the subject of the contract is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery.
13. ADDITIONAL RIGHT TO RETURN GOODS
13.1 For all purchases of goods, Westwing grants you an additional right of withdrawal for a total period of 30 days from receipt of the goods, in addition to and independently of the statutory right of unilateral termination of the contract under Article 12. This additional right of withdrawal granted to you by Westwing allows you to terminate the purchase contract even after the expiry of the 14-day period for unilateral termination (see Article 12) by returning the goods to Westwing within 30 days of receipt.
However, if you exercise this additional right of return after the expiry of the 14-day period for exercising the statutory right of unilateral termination of the contract, the prerequisite for exercising the additional right of return is that you return the entire goods, in perfect condition and without damage to the original packaging of the goods. Otherwise, Westwing reserves the right to refuse the return. Please note that when returning goods under the additional right of return, you bear the transport risk if you do not take delivery of the product (depending on the method of delivery of the product). The additional right of return does not apply to the purchase of gift vouchers.
13.2 The refund will be made to the payment method you used for payment.
13.3 Your statutory right to unilaterally terminate the contract (see Article 12) is not subject to the requirements set out in this Article 13 and applies independently of them. Until the statutory right to unilaterally terminate expires, only the statutory conditions set out for exercising the right to unilaterally terminate the contract apply. This contractually granted (additional) right of withdrawal does not limit your claims under the regulations for material defects or commercial warranty, if provided for.
14. COMPENSATION OF DELIVERY AND SERVICE COSTS IN THE EVENT OF PARTIAL RETURN OF GOODS
If you terminate the contract for only part of the goods in the order (partial termination), Westwing will refund you the payments for the returned goods, including delivery costs. However, if (part of) the delivery costs would have been incurred even if you had ordered only the goods for which you did not unilaterally terminate the contract, the full delivery costs will be excluded from the refund.
15. RETENTION OF OWNERSHIP
The goods remain the property of Westwing until full payment has been made.

17. LINK DISCLAIMER
To the extent that www.westwing.hr refers to websites of other providers via links, Westwing has no influence on their content, does not promote them as its own and assumes no liability or responsibility for their content. The respective provider or operator of the pages is always responsible for the content of the pages. As soon as Westwing becomes aware of legal violations of the websites of other providers, the corresponding links on www.westwing.hr will be removed immediately.

Downloading or use for personal use is permitted. Publication, transmission, reproduction or any other use of the content/material is not permitted.
All rights to use the materials on www.westwing.hr belong to Westwing or our partners. Use of the materials, in any form, without the express written permission of Westwing is prohibited.
All trademarks used on the website may not be used without the prior written permission of Westwing.
20. ALTERNATIVE DISPUTE RESOLUTION
In accordance with Article 14(1) of Regulation (EU) No 524/2013 on online dispute resolution for consumers (the “ Regulation on Online Dispute Resolution for Consumers ”), we inform you that the European Commission offers a platform for online dispute resolution in accordance with Article 14(1) of the Regulation on Online Dispute Resolution for Consumers. 21. CHANGES TO GENERAL TERMS AND CONDITIONS
Westwing reserves the right to change the website and these terms and conditions at any time. Your order will be governed by the terms and conditions in effect at the time you place your order, unless a change to these terms and conditions is required by law or government regulation.
22. FINAL PROVISIONS
22.1 Any dispute arising from or in connection with the use of the website www.westwing.hr shall be governed by the law of the Republic of Croatia, excluding its conflict of law norms.
22.2 If any provision is invalid or ineffective, the remaining provisions shall remain valid. Instead of the invalid or ineffective provisions, the relevant statutory provisions shall apply.
